Davaar Cave Painting vandalised !!!

I think its a good thing that there is a fund set up to restore this painting whether it be the original or not - the original would have been surely long gone by now if it had not been repainted. If it atracts visitors to the town then it is worth while restoring it. I think the perpetrator of this vandalism, malicious mischief or whatever (for malicious mischief is what they would probably be charged and tried on as it holds greater punishment and is usually used if the value of the damage is high and shown to be of malicious intent) (actually there is no common law charge of vandalism in Scotland). What ever it was it was wrong and we should all, that is anyone who wants to, help to fix it if we can. I doubt they will catch the person who did this, I cant believe it will be a local, and I think he came with a purpose, whatever it was in his mind, achieved that purpose and no doubt took the 5 o'clock 'bus out of town. If caught, tried and convicted the court could impose a compensation order if he has the means to pay it however no doubt it will take years to collect at a pound a week!! I lived in Glasgow when the Dali painting of the Christ of St John was vandalised and as someone who went to the Art Galleries regularly I was upset by this. Of course that painting would be insured, I dont know if you can insure a cave painting. I just dont get the mind set of someone who would do this or deface anything for example the changing rooms and not feel black ashamed.

Is it actually a crime

Postby Ticketty Boo! » Wed Aug 09, 2006 10:01 am

I'm going to ask a slightly different question - has a crime actually been committed? A moral crime, or a crime against decency - without a doubt. I think what has happened is a terrible shame, and has spoiled an object of beauty that took time and talent (several talents) to produce. I'm merely playing devil's advocate here, or asking the same question that the Procurator Fiscal would undoubtedly ask................

What breach of criminal law has taken place?

If none, then it's not even a Police matter.

I think the term used throughout with regard to what happened to the painting is vandalism. According to section 52 of the Criminal Law (Consolidation) (Scotland) Act 1995 this is defined as follows:

(1) Subject to subsection (2) below, any person who, without reasonable excuse, wilfully or recklessly destroys or damages any property belonging to another shall be guilty of the offence of vandalism.

(2) It shall not be competent to charge acts which constitute the offence of wilful fire-raising as vandalism under this section.

(3) Any person convicted of the offence of vandalism shall be liable on summary conviction—
(a) in the district court, to imprisonment for a term not exceeding 60 days, or to a fine not exceeding level 3 on the standard scale, or to both;
(b) in the sheriff court—
(i) for a first such offence, to imprisonment for a term not exceeding 3 months, or to a fine not exceeding the prescribed sum (within the meaning of section 225(8) of the [1995 c. 46.] Criminal Procedure (Scotland) Act 1995), or to both; and
(ii) for any subsequent such offence, to imprisonment for a term not exceeding 6 months, or to the fine mentioned in sub-paragraph (i) above, or to both.

Of course the question returns to who owns the painting and if this is seen, in the eyes of the law, as being the owner of the island then in my opinion the above law seems to fit the answer to your question Ticketty Boo!

because obviously a lot of people do care
i should have said why do they care so much
its just someone drawing on a wall
if someone has the right to 'restore' it
then whats stopping someone painting over it?

if the police are going to arrest whoever did it, then they should arrest whoever paints it again
because hes just done the exact same thing
or is that ok because everyone will like it?

I think that the more people care, the better chance we have of catching the culprit, getting the painting restored quicker and avoiding any further incidents like this.

Yep Pete,
so according to this formula, you wont catch the culprit, it will be restored on a Scottish Parliament timescale and it will happen again a fortnight later.

Beachcomber - as far as Lascaux go's, though I do belive bison and deer roamed Europe many moons ago more than I believe a chippie was the son o' God, the people that painted them images were painting their hoose for beggars sake, unlike a random cave on Davaar and so yes it should be protected more - in fact folk should not be allowed in without an invite!

I was under the impression that piddling little issues did'nt concern you.

ah well if you're busy Jack... I know that multi-tasking thing isn't easy - I tried it once and... well, before I was released from hospital I was told I should be able to play the guitar again, but maybe playing by ear wasn't such a good idea even after it was sown back on

oh yea... tell Sweltered if he wants his calculator back I'm finished with it! (This, believe it or not, was a subtle attempt to get this topic back on track... I'm not sure I even understand how its meant to do that tho :?)

Cave Painting Spiritual

Postby Islander » Mon Aug 21, 2006 12:23 am

The defacing of the cave painting was disrespectful to the artist...but ironically alot of the locals have bothered to go over to the island now and appreciate the beauty of it. So maybe the 'culpit' has done a good thing in the bigger sense. Also isnt Che Guvara a kinda like 'Jesus' figure..someone who wanted to change the world to for the better of humanity like all the great Spiritual pioneers...Mohammed, Jesus, Budhaa etc

Seems that calling Che Guevara a spiritual leader is a stretch. He was a revolutionary leader leading people in guerilla warfare. Probably more appropo to compare him to leaders during the America revolution, or William Wallace, or even present day warfarers in Israel, Lebanon, and Iraq rather than to Jesus, who taught more of freeing people of their own inner shackles; more about changing the person than changing the world. I am also fairly sure Buddha didn't encourage warfare against governments either.
